Welcome to Flahive AI. Please read these Terms of Service carefully before using our service. By accessing or using Flahive AI, you agree to be bound by these Terms and our Privacy Policy.

1. Acceptance of Terms

By creating an account, accessing, or using Flahive AI (the "Service"), you confirm that you have read, understood, and agree to be bound by these Terms of Service ("Terms") and our Privacy Policy. If you do not agree to these Terms, you may not use the Service.

We may update these Terms from time to time. If we make material changes, we will notify you by updating the "Last Updated" date above and, where appropriate, by providing additional notice such as an email or an in-app notification. Your continued use of the Service after any changes constitutes your acceptance of the updated Terms. If you do not agree to the updated Terms, you must stop using the Service.

2. Description of Service

Flahive AI is an AI-powered supportive chat platform designed to provide a compassionate, judgment-free space for you to talk through your thoughts, feelings, and everyday challenges. The Service is intended as a supplementary wellness and emotional support tool — not a replacement for professional mental health care, therapy, or medical treatment of any kind.

The conversational AI within Flahive AI is designed to offer empathetic, supportive responses; share general wellness information and coping strategies; encourage you to seek professional help when appropriate; and provide crisis resources when you may be at risk. The Service is not designed or equipped to diagnose conditions, prescribe treatments, or provide professional clinical care.

3. Critical Disclaimer — Not Therapy or Medical Care

Please read this section carefully. It contains important information about the nature of this Service.

3.1 No Therapeutic or Clinical Relationship. Flahive AI is NOT a licensed mental health treatment provider. Your use of this Service does NOT create a therapist-client, counselor-client, psychologist-patient, social worker-client, or any other professional mental health relationship between you and Flahive AI or any individual or entity associated with this Service.

3.2 Not a Substitute for Professional Care. The Service is not a substitute for professional mental health treatment, therapy, counseling, psychiatry, psychology, or medical care of any kind. If you are experiencing mental health symptoms, a diagnosable condition, substance use issues, or any physical medical issue, please seek care from a qualified, licensed professional.

3.3 AI Limitations. The Service uses artificial intelligence to generate responses. AI-generated responses are produced algorithmically and may be inaccurate, incomplete, outdated, or inappropriate for your specific circumstances. The AI does not have knowledge of your full personal history, medical records, medications, prior diagnoses, or the many other contextual factors that a treating clinician would consider.

3.4 Not HIPAA-Covered. Flahive AI is not a "covered entity" or "business associate" under the Health Insurance Portability and Accountability Act (HIPAA). Information you share through the Service is not protected as "protected health information" under HIPAA. If you require HIPAA-compliant services, please consult a licensed healthcare provider directly.

3.5 Professional Identity Disclaimer. While Flahive AI is inspired by and associated with a licensed mental health professional, the AI system itself is not practicing therapy, counseling, or any licensed mental health service. No content generated by the AI should be interpreted as professional clinical advice from any licensed individual.

4. Emergency Situations

Flahive AI is NOT designed for crisis intervention and is NOT equipped to provide emergency services.

IF YOU ARE IN IMMEDIATE DANGER OR EXPERIENCING A MENTAL HEALTH EMERGENCY — including but not limited to thoughts of suicide, self-harm, harming others, or a severe mental health crisis — DO NOT rely on Flahive AI. Instead:

  • Call or text 988 (Suicide and Crisis Lifeline, available 24 hours a day, 7 days a week)
  • Call 911 or your local emergency services
  • Text HOME to 741741 (Crisis Text Line, available 24/7)
  • Go to your nearest emergency room or call a trusted person

By using the Service, you acknowledge and agree that you will not rely on Flahive AI as your primary or only resource in any emergency situation.

5. Eligibility

5.1 Age Requirement. You must be at least 18 years of age to use the Service. By using the Service, you represent and warrant that you are at least 18 years old. If you are under 18, you are strictly prohibited from creating an account or using the Service in any manner.

5.2 Legal Capacity. You represent that you have the full legal capacity to enter into and be bound by these Terms, and that doing so does not violate any applicable laws or agreements.

5.3 Geographic Availability. The Service is primarily intended for users located in the United States. We make no representation that the Service is appropriate or available in other jurisdictions. If you access the Service from outside the United States, you do so at your own risk and are responsible for compliance with applicable local laws.

5.4 No Prior Bans. You may not use the Service if you have previously been suspended or terminated from the Service for violation of these Terms.

6. User Accounts

6.1 Registration. To access the full features of the Service, you must create an account by providing a valid email address and a secure password. You agree to provide accurate, current, and complete information during registration and to update your information to keep it accurate.

6.2 Account Security. You are solely responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately at support@flahiveai.com if you become aware of any unauthorized use of your account or any other breach of security. We are not liable for any loss or damage arising from your failure to protect your account credentials.

6.3 One Account Per Person. You may not create more than one account per individual. Accounts are personal and non-transferable. You may not share your account with any other person.

6.4 Account Responsibility. You are responsible for all content submitted through your account and all actions taken under your account credentials, regardless of whether those actions were authorized by you.

7. Acceptable Use

You agree not to use the Service to:

  • Provide false, misleading, or fraudulent information, or impersonate any person or entity;
  • Submit content that is illegal, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable;
  • Attempt to manipulate, jailbreak, or circumvent the AI to produce content that violates these Terms or applicable law;
  • Use the Service for any commercial purpose, including reselling access, without our prior written consent;
  • Attempt to reverse engineer, decompile, disassemble, or otherwise extract source code from the Service or its underlying systems;
  • Circumvent, disable, or otherwise interfere with any security features, authentication systems, or access controls;
  • Use the Service for any purpose that is unlawful under applicable local, state, national, or international law;
  • Access or attempt to access other users' accounts, data, or personal information;
  • Use automated bots, scrapers, or scripts to access, interact with, or extract data from the Service without our express written permission;
  • Upload or transmit viruses, malware, or any other malicious code;
  • Engage in any conduct that restricts or inhibits any other user's use or enjoyment of the Service.

We reserve the right to investigate and take appropriate action against anyone who, in our sole discretion, violates this section, including removing content, suspending accounts, and reporting to law enforcement authorities.

8. User Content and Conversations

8.1 Ownership. When you use the Service, you provide input to the AI system, including messages, information, and other materials you submit ("User Content"). You retain ownership of your User Content. We do not claim ownership of any User Content you submit.

8.2 License to Us. By submitting User Content, you grant Flahive AI a limited, non-exclusive, worldwide, royalty-free license to use, store, process, and analyze your User Content solely to provide and operate the Service and as described in our Privacy Policy. We do not use your User Content to train AI models without your explicit consent.

8.3 Content Responsibility. You are solely responsible for your User Content. We do not endorse, verify, or accept responsibility for User Content. You represent and warrant that you have all rights necessary to submit your User Content and that it does not violate any third-party rights or applicable law.

8.4 AI Responses. Responses generated by the AI ("AI Content") are the output of algorithmic processing and are not the views or professional opinions of any individual. AI Content may contain errors and should not be relied upon as professional, medical, legal, or any other type of licensed advice.

8.5 Conversation Storage. Your conversations may be stored to allow you to access chat history. Please see our Privacy Policy for details on how long we retain conversation data and your options for deletion.

9. Intellectual Property

9.1 Our Property. The Service and all of its components — including but not limited to the software, code, design, user interface, branding, text, images, logos, and AI systems — are owned by or licensed to Flahive AI and are protected by applicable intellectual property laws. Nothing in these Terms grants you any right, title, or interest in the Service beyond the limited right to use it in accordance with these Terms.

9.2 Restrictions. You may not copy, modify, distribute, sell, lease, sublicense, or create derivative works based on the Service or any part of it without our prior written consent.

9.3 Feedback. If you provide any feedback, suggestions, or ideas about the Service ("Feedback"), you grant us a perpetual, irrevocable, royalty-free right to use that Feedback for any purpose without any obligation to you.

10. Third-Party AI Services

The Service relies on third-party artificial intelligence model providers to generate conversational responses. By using the Service, you acknowledge that:

  • Your messages and conversation content are transmitted to and processed by these third-party AI systems;
  • These providers operate under their own terms of service and privacy policies;
  • We cannot guarantee the complete confidentiality of information processed by third-party AI systems;
  • AI-generated responses are the output of algorithms and may contain errors, biases, or inappropriate content.

We take reasonable steps to protect your data in our agreements with AI providers and to minimize unnecessary data sharing. Please review our Privacy Policy for more information about how AI providers process your data.

11. No Professional Advice

11.1 General Information Only. All content and responses provided through the Service are for general informational and supportive purposes only. Nothing provided through the Service constitutes or should be construed as professional mental health, medical, psychiatric, psychological, legal, financial, or any other licensed professional advice.

11.2 Consult a Professional. Always seek the advice of a qualified healthcare provider, therapist, attorney, or other licensed professional with any questions you have regarding a medical condition, mental health issue, legal matter, or other situation requiring professional judgment. Never disregard or delay seeking professional advice based on information or responses from the Service.

11.3 No Diagnoses. The Service does not and cannot diagnose mental health conditions, medical conditions, or any other clinical condition. Any information that could be interpreted as a diagnosis is not intended as such and should not be relied upon as a diagnosis.

12. Disclaimer of Warranties

This section limits our legal liability. Please read it carefully.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMISSIBLE UNDER APPLICABLE LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, AND FREEDOM FROM INTERRUPTION.

WE DO NOT WARRANT THAT: (A) THE SERVICE WILL MEET YOUR SPECIFIC REQUIREMENTS; (B) THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE; (C) THE RESULTS OBTAINED FROM USING THE SERVICE WILL BE ACCURATE OR RELIABLE; (D) ANY ERRORS IN THE SERVICE WILL BE CORRECTED; OR (E) THE SERVICE OR THE SERVERS THAT MAKE IT AVAILABLE ARE FREE FROM VIRUSES OR OTHER HARMFUL COMPONENTS.

13. Limitation of Liability

This section limits our legal liability. Please read it carefully.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, FLAHIVE AI AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, LICENSORS, AND SERVICE PROVIDERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO: LOSS OF PROFITS, LOSS OF DATA, LOSS OF GOODWILL, BUSINESS INTERRUPTION, PERSONAL INJURY, OR ANY OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT SHALL OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THESE TERMS OR THE SERVICE EXCEED THE GREATER OF: (A) THE TOTAL AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100.00 USD).

SOME JURISDICTIONS DO NOT ALLOW THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES. IN SUCH JURISDICTIONS, OUR LIABILITY SHALL BE LIMITED TO THE GREATEST EXTENT PERMITTED BY LAW.

14. Indemnification

You agree to indemnify, defend, and hold harmless Flahive AI and its affiliates, officers, directors, employees, agents, and service providers from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with: (a) your access to or use of the Service; (b) your violation of these Terms; (c) your User Content; (d) your violation of any applicable law or regulation; or (e) your violation of any third-party rights. We reserve the right, at our own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you.

15. Termination

15.1 Termination by You. You may terminate your account at any time by contacting us at support@flahiveai.com.

15.2 Termination by Us. We reserve the right to suspend or terminate your access to the Service at any time, with or without cause and with or without prior notice, including for any violation of these Terms, conduct that we determine to be harmful to other users or to the Service, or for any other reason in our sole discretion.

15.3 Effect of Termination. Upon termination for any reason, your right to use the Service will immediately cease. Sections of these Terms that by their nature should survive termination will survive, including: intellectual property provisions, content license grants, warranty disclaimers, limitations of liability, indemnification, and dispute resolution provisions.

16. Governing Law and Dispute Resolution

16.1 Governing Law. These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions.

16.2 Informal Resolution. Before pursuing any formal dispute resolution, you agree to first contact us at legal@flahiveai.com to attempt to resolve the dispute informally. We will make good faith efforts to resolve the matter within thirty (30) days.

16.3 Binding Arbitration. If informal resolution fails, any dispute, claim, or controversy arising out of or relating to these Terms or your use of the Service shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The arbitration shall take place in Orange County, California. The arbitrator's decision shall be final and binding. Judgment on the award may be entered in any court of competent jurisdiction.

16.4 Class Action Waiver. YOU AND FLAHIVE AI AGREE THAT EACH PARTY MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY CLASS ACTION, CONSOLIDATED ACTION, OR REPRESENTATIVE PROCEEDING.

16.5 Exceptions. Notwithstanding the foregoing, either party may seek emergency injunctive or equitable relief in any court of competent jurisdiction to prevent irreparable harm pending the resolution of a dispute.

17. Changes to These Terms

We reserve the right to modify these Terms at any time in our sole discretion. If we make material changes, we will provide notice through the Service (such as an in-app notification) or by sending an email to the address associated with your account. For non-material changes, we may update the "Last Updated" date at the top of this page without other notice.

Your continued use of the Service after the effective date of any modification constitutes your acceptance of the updated Terms. If you do not agree to any updated Terms, you must stop using the Service. We encourage you to review these Terms periodically.

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will continue in full force and effect. These Terms, together with our Privacy Policy, constitute the entire agreement between you and Flahive AI concerning the Service and supersede all prior agreements.
